The Texas Department of Health Services (DSHS) has updated the Asbestos Fines Matrix to reflect theAsbestos health regulations in Texasvalid from July 8, 2021. The sanctions matrix was published inJuly 1, 2022 edition of the Texas Register, replaces the matrix published in the April 17, 2020 edition and is available for review in the new versionSanction matrix.

Update on COVID-19 waivers for all DSHS Asbestos Licensees/Registrars
On March 13, 2020, the Office of the Governor issued a Disaster Statement in response to COVID-19, suspending laws and rules related to applications for asbestos licensing or registration. During the suspension, DSHS extended license expiration dates and waived late fees for those who submitted renewal requests.
On July 19, 2021, the Office of the Governor lifted the temporary suspension of DSHS statutes and rules related to the COVID-19 disaster.
Effective September 1, 2021, the DSHS will no longer extend license expiration dates or waive late fees for asbestos license renewal applications or registrant licenses.
What this means for license holders:
To avoid late fees, you must submit your license or registration renewal application by the deadline that would normally be submitted prior to the governor's temporary suspension. After September 1, 2021, you must also submit the required application/registration fees along with all required supporting documents as per the requirements applicable to your type of license or registration.
To avoid late fees, we recommend checking the expiration date of your current license.

GUIDANCE TO ASBESTOS MUTUALITY AND TEMPORARY LICENSES/REGISTRATION IN TEXAS
ORIENTATION DATE: March 5, 2021
On February 12, 2021, Governor Greg Abbott issued a statewide disaster declaration in response to the severe winter weather in Texas. The Texas Department of Health (DSHS) has received inquiries from businesses and individuals outside of the state of Texas.
We have licensing provisions in the Texas Asbestos Health Protection Rules (TAPHR) for out-of-state residents. The reciprocity rules can be foundHere.
A Provisional License/Registration Letter will be sent upon approval of a Provisional License/Registration Application. A copy of this letter evidencing provisional license/registration must be carried at all times when working in a workplace subject to TAHPR or involved in asbestos-related activities. A copy of this letter with a government-issued ID must be presented to any DSHS inspector requesting proof of license.
A holder of a provisional license/registration issued under 25 TAC §295.39(g) may apply for a full license or registration under 25 TAC §295.38(k), which includes the requirement to complete at least three hours of training with a Texas ' DSHS-licensed provider's training course on Texas Laws and Regulations.

The inspection
All asbestos abatement projects remain subject to unannounced inspections. Failure to follow reasonable mitigation procedures is addressed through standard compliance procedures, which may include revocation of licenses granted to out-of-state licensees or registrants.

Passing the State of Emergency for the Texas Asbestos Health Protection Rule
Note: This is an update and change to the July 14, 2020 emergency rule.
To protect asbestos licensees and the public health, safety and welfare during the COVID-19 pandemic, the Executive Commissioner of HHSC, on behalf of the DSHS, adopts an emergency rule amendment to §295.65, Training: Approval of Training Courses, which specifies requirements that the DSHS online -Recognized refresher courses as an alternative to face-to-face refresher courses. Completion of an annual asbestos refresher course is required to renew an asbestos license and participate in asbestos detection and removal, which is an essential service in Texas. The rule requires DSHS approval for online refresher courses; requires that online refresher courses have systems to authenticate student identities and protect sensitive user information, provide an interactive component, track time spent online, provide technical support, provide a separate certificate, and allow the DSHS to administer course exams to allow; requires submission of a permit application and requires additional records.
The rule is effective9 January 2021jIt is valid for 120 days. The rule expires in8. May 2021, which can be extended for a further 60 days if required.

COVID-19 Asbestos Licensing Information

Asbestos testing will reopen. All test takers must bring a mask, pencil and a completed COVID-19 SELF-ASSESSMENT FORM to the test site.
If an examinee does not bring a completed COVID-19 SELF-ASSESSMENT FORM, their own mask or pen, they will not be admitted to the exam. Sharing of articles is not allowed.

Emergency rule of the Texas Asbestos Health Protection Rule
On July 13, 2020, the Texas Department of Health and Human Services submitted an emergency rule amendment to the Texas Asbestos Health Protection Rule for posting in the Texas Registry in response to COVID-19. The Emergency Rule addresses the process for a licensed training provider to obtain approval to offer a live online asbestos refresher course as an alternative to an in-person asbestos refresher course. The rule takes effect immediately and will remain in effect for120 dia. The emergency regulation can be extended by a further 60 days if necessary.

COVID-19 Asbestos Licensing Information

Due to the current COVID-19 disaster state in Texas, the following exemption has been requested by the State Department of Health Services (DSHS) and granted by the Office of the Governor:
Delay in filing the asbestos license renewal application
Pursuant to Section 418.016 of the Texas Government Code, the Office of the Governor grants DSHS' motion for suspension of Tex. Occupancy Code 1954.201(a) to the extent necessary to allow an asbestos licensee whose license expires after March 13, 2020 to delay filing its renewal application, renewal fees and compliance with the requirements for the license. This exemption suspends the two-year term of a license while the disaster declaration is in effect and applies only to individuals who have previously obtained a license from the DSHS asbestos program and have industry experience.
Pursuant to the May 20, 2020 order of the State Department of Health Services, late fees and license waivers will be extended for individuals currently licensed in the asbestos program with a license expiration date of March 13, 2020 or later. for 6 months after the expiry date of the license or registration. Exceptions to this are training providers, consulting agencies, management planning agencies, laboratories and asbestos transporters.
