Waiver of Covid-19 exemptions for all DSHS asbestos licensees/registrars
On March 13, 2020, the Office of the Governor issued a Disaster Statement in response to COVID-19, suspending laws and regulations related to asbestos permit or registration renewal. With the suspension, the DSHS extended license expiration dates and waived late fees for individuals requesting renewal.
On July 19, 2021, the Office of the State Governor ended the temporary suspension of DSHS statutes and rules related to the COVID-19 disaster.
Effective September 1, 2021, DSHS will not extend license expiration dates or waive late fees for asbestos license or registration license renewal services.
What this means for license holders:
To avoid late fees, you must submit your application for a license or registration renewal within the timeframe that normally could have been submitted prior to the governor's suspension. After September 1, 2021, you must also submit the required registration/service fees along with any required supporting documentation as per the appropriate requirements in your license or registration type.
To avoid late fees, we recommend checking the expiration date of your current license.

GUIDANCE TO ASBESTOS MUTUALITY AND TEMPORARY LICENSES/REGISTRATION IN TEXAS
ORIENTATION DATE: March 5, 2021
On February 12, 2021, Governor Greg Abbott issued a statewide disaster declaration in response to extreme winter weather in Texas. The Texas Department of Health (DSHS) has received inquiries from businesses and individuals outside of the state of Texas.
We have licensing provisions within the Texas Asbestos Health Safety Guidelines (TAPHR) for out-of-state residents. The rules of reciprocity are discoveredHere.
A preliminary license/registration letter is likely to be sent upon approval of a preliminary license/registration utility. You should always carry a copy of this letter containing proof of provisional license/registration when faced with a TAHPR workplace issue or involved in any asbestos-related activity. A duplicate of this letter with a government-issued ID will be offered to any DSHS inspector requesting proof of license.
A holder of a provisional license/registration issued under 25 TAC §295.39(g) may apply for a full license or registration under 25 TAC §295.38(good), which introduces the requirement to complete at least three hours of training with a Texas ' Offerer . DSHS-licensed training facility that masks Texas rules and regulations.

All asbestos removal work is subject to unannounced inspections. Failure to follow proper mitigation procedures is likely to be addressed through standard enforcement procedures, which may include revocation of licenses issued to out-of-state licensees or registrars.

Passing the emergency rule for the Texas Asbestos Health Safety Rule
Note: This is an update and change to the July 14, 2020 emergency rule.
To protect asbestos licensees and the health, safety and well-being of the general public during the COVID-19 pandemic, the HHSC Governance Commissioner, on behalf of the DSHS, is adopting an emergency rule amendment to Section 295.65, Training: Approval of Training Programs Whose Units Make Requirements of the DSHS to approve online refresher programs instead of in-person refresher programs. Completion of an annual asbestos refresher course is required to resume an asbestos license and interact with asbestos detection and removal, which is an essential service in Texas. The rule requires DSHS approval for online refresher courses; Needs online upgrade programs to have programs to authenticate student IDs and protect sensitive consumer data, present an interactive portion, track time spent online, provide technical support, provide certificates of completion, enable course exams through the DSHS; requires utility submission for approval and requires reinforced recording.
The rule is efficient.9 January 2021,and remains effective for 120 days. The rule expires in8. May 2021, and will be extended for another 60 days if necessary.

Asbestos testing will reopen. All test takers must return masks, pens, and a completed COVID-19 SELF-ASSESSMENT FORM to the testing site.
If an examinee does not submit a completed COVID-19 SELF-ASSESSMENT FORM, their own masks, or pens, they will not be admitted to the exam. Sharing is probably not allowed.

Emergency rule of the Texas Asbestos Health Protection Rule
On July 13, 2020, the Texas Department of Health Providers submitted an emergency rule amendment to the Texas Asbestos Health Safety Rule for posting in the Texas registry in response to COVID-19. The Emergency Rule addresses the method for a licensed training provider to obtain approval to conduct a live online asbestos refresher course rather than an in-person asbestos refresher course. The rule is effective immediately and can remain in effect for120 dia. The emergency rule can also be extended for another 60 days if it is critical.

Due to the current COVID-19 state of emergency in Texas, the following exemption has been requested by the State Department of Health Services (DSHS) and granted by the Office of the Governor:
Renewal Software Asbestos License Late Filing
Pursuant to Section 418.016 of the Texas Code of Entitlement, the Office of the Governor grants the DSHS' request to have Tex deleted. Allocation code 1954.201(a) to a critical extent to allow an asbestos licensee whose license expires after March 13, 2020 to delay the registration of its renewal service, renewal fees and compliance with the requirements for the license. This exemption suspends the two-year term of a license while the disaster declaration is in effect and applies only to individuals who have previously been licensed under the DSHS asbestos program and have industry experience.
Per the May 20, 2020 order of the State Division of Health Services, individuals currently licensed in the asbestos program whose license expires on March 13, 2020 or later may lose their late dues and their licenses will be renewed 6 months after the expiration date the license or registration. Exceptions to this are training providers, management companies, management planning companies, asbestos laboratories and transporters.
